Hey, I had someone point this post out.

It's a huge grey area but it would be our recommendation that you treat suits as products rather than unique artworks due to the materials used. It's more likely to draw attention because it's not a typical painting or limited print run.

Can chat if needed.

Labelling, more specifically using digital options instead of a printer item.

Sadly key information needs to be included ON the product (sticker), with it (a print out) or on the packaging itself.

After talking to the Card market CS team regarding #gpsr, they replied with a list to the manufacturers for your reference (link below) and the following statement

"You don't have to worry about anything else. We already provide all the requested information. You can sell as usual."

Important clarification has come out.

For those of you who sell to businesses in the EU then #GPSR is not a requirement and is out of scope.

If you are a manufacturer but don't sell to #EU consumers then all you need is basic product documentation.

GPSR doesn't state any requirements for customs but gives them a framework to confirm against. They could open a parcel and verify against GPSR but is by no means a requirement for the regulation.

Agreed the likelihood of notification is very small for micro/small businesses.

I recommend a basic risk assessment on your portfolio and a GPSR statement which says your product is exclusively for businesses and not consumers.

Your customer can then store a copy of your risk assessment as their due diligence as you are still the manufacturer of the digital product (it's dumb)

Customs wouldn't investigate that, it would be a market surveillance body and it's very unlikely they would know unless a consumer notified them.

The aim is to combat dangerous products from temu, Shein etc however it's overreached with no clarification.

As you are selling a purely digital item to a business and not a consumer then you are not required to have a rep.

Hey, yeah digital products are in scope. Is there anything particular you want to know?

No worries! There would need to be some info as you are a manufacturer however it would be very limited and if the product was made physical then that is a NEW product at that point which your business customer is responsible for.

Article 2 and 4 handle scope and refer to consumers (which businesses aren't).

Once the meeting recording is posted then there can be an official quote from the Global Trade Department. (3/3)

Additionally products such as digital only media, books etc have a small margin of risk that the paperwork will be proportional.

If you sold a 3d file to a business & that file was never intended for a consumer then minor admin is required due to no consumer interaction and minimal risk. (2/3)

A mix of both. GPSR exclusively only mentions consumers when talking about scope and products. Andrea Collins – Managing Director of Global Trade Department was quoted on B2B requiring minimal documentation if they aren't sold for consumers. (1/3)
