Those outraged that a jury would nullify assault charges over a thrown sandwich should ponder hard the consequences. If a dissident would get the same charge for throwing a sandwich as throwing a fist... they must surely wonder why not throw the fist?

Technically they were guilty; we knew that. But we felt they had a good point, and we may have done the same as they did.

It's one thing to spread around the phrase, it's another to keep in-depth resources about it available online! The Fully Informed Jury Association has done immense work since 1989. But we depend upon donations from people like you!

Jurors do not need to be informed about nullification to nevertheless have their conscience and good sense bleed out into verdicts.

But, conversely, the more that jurors learn about their rights, the more free they feel to apply their conscience and common sense.

Jury Nullification is not some distinct zone of jury resistance, but something that happens *on a spectrum.*

Three grand juries and a trial jury all refused to accept Piro's account of assault on an officer. We do not have to believe that those juries reject the law against assault for them to have nullified certain readings and applications of said law.

As Lysander Spooner pointed out, juries must inevitably judge not just the "bare facts" but the contours of the law itself; the two are inexorably intertwined.

And yet police have repeatedly charged people they were brutalizing with assault for even just bleeding on them.

When it comes to the law, to say nothing of instances of state violence being applied, application of common sense cannot be taken for granted.

Commentators have split on this. Many have noted, persuasively, that an officer incidentally getting a minor scuff while shoving around a civilian exercising their constitutional rights should not count as assault on that officer.

Rather than dropping the case, Pirro took the quite unusual path of charging it as a misdemeanor and taking Reid to trial. Once again, a trial jury was having none of it and acquited.

Was this Jury Nullification?

A judge dismissed the first, on the grounds that the officer's testimony was plainly falsified by video evidence. But Pirro took other felony charge of assault before federal grand juries a total of three times, and three times those juries refused to indict.

The FBI agent's hand was allegedly scuffed against the wall during this as she allegedly flailed her arms.

US Attorney Jeanine Pirro quickly pursued felony charges against Ms Reid for "assaulting" both officers.

What Constitutes Jury Nullification?
