When the group reached the front desk, the woman learned she didn't have a hotel room. Ingrassia then informed her that she would be staying with him, according to five administration officials familiar with the episode. Eventually the woman discovered that Ingrassia had arranged ahead of time to have her hotel room canceled so she would have to stay with him, three of those officials said.

It would have been very defensible in court. For Trump to have prevailed he'd have had to shown that (1) there is a morally and reputationally significant difference between forcing your penis vs. finger into an unwilling victim, and that (2) Trump had a reputation to damage in the first place.

That's the FBI's definition of rape for UCR. It's not the narrower, NY-specific definition the jury had to rule on in Carroll's case.

The ABC News settlement makes zero sense from a legal standpoint. It assumes there is a moral or reputational difference between forcibly penetrating a woman’s vagina with fingers and doing so with a penis. It also assumes that Trump has a reputation that could suffer damage.
