In our recent experience with purchasing original works from Canada, France, Mexico, Spain, and Italy, we have had to educate (aka “argue with” by presenting the applicable exemption statute) the Custom’s rep to get the tariff charge reversed/credited. So far, it has worked, but required effort.

Quoting from the article from the Center for Art Law:
“At this stage, it appears that the interpretation of tariff classification is ultimately left to the discretion of the Customs and Border Protection (CBP) officer reviewing the shipment.”

With all the crazy shit going on with tariffs, it is helpful to know that original artwork, paintings, drawings, and the like are exempt from tariffs.
So, exercise your First Amendment’s rights and support artists and buy art.
