Who gets to own hospitals and bill Medicare?
In Physician Hospitals of America v. Sebelius, physician-owned hospitals challenged Section 6001 of the ACA as unconstitutional. But the Fifth Circuit never reached the constitutional merits. The Court ruled that since the claims “arise under” Medicare,

they miust go through Medicare’s administrative process first before the parties could obtain subject matter jurisdiction in federal courts.
Advocates for physician-owned hospitals say these facilities boost doctor autonomy, streamline bureaucracy,

and can save Medicare over a billion dollars a year in treating its most expensive conditions. Opponents say that physician-owned hospitals cherry-pick profitable, healthier patients and leave community hospitals with sicker patients and costlier cases.
