Appreciate this coverage but it is hard to explain to people not in the Chicago area that THESE ARE NOT PROTESTS.

This is people coming out of their homes, doing anything in their power to try to stop their neighbors from being kidnapped.

It is coming for your city next, please be prepared.

Conservative individualism in a nutshell: the same people who said we need mass deportation so we can take care of “our own” are cheering on the suspension of SNAP because now they don’t want other people to receive “handouts.” They proudly hate other people. But to be clear the three legal sources quoted, @jcschwartzprof.bsky.social, Alex Reinert, and Anya Bidwell are the best of the best in this area. They are rightfully concerned about limits on accountability for fed misconduct—especially as compared to 1983 litigation against state/local officers.

Yes, that is exactly right. The majority rule in the circuits is that the discretionary functions exception does not immunize unconstitutional conduct (including arrests without probable cause). I likewise thought the article overstated that risk.

Despite the difficulty, people SHOULD bring these claims. There are very good lawyers who are experts in this practice. There are opportunities for success and perhaps most importantly, the chance for DISCOVERY.

If you are confident that a boat near Venezuela is carrying drugs, you stop it and board it. That way, you have evidence.

If you don't really care if a boat near Venezuela is carrying drugs, but you just want to kill people, you blow the boat up. That way, the irrelevant evidence is gone.
