Así cada año cientos de personas son encarceladas por participar en su propio proceso migratorio, incluso sin pruebas que lo demuestren‼️
La mayoría son condenados a 3 años de prisión, pero algunos son condenados a 8 años o más (especialmente si hay personas fallecidas durante el trayecto).

Además, la policía y Frontex ejercen presiones para obtener estas declaraciones acusatorias y, como recoge el informe de Irídia y Novact, ofrecen la regularización de la situación administrativa si acusan al quien conducía la embarcación.

▶️ La acusación se basa a menudo SÓLO en el testimonio de 1/2 personas que viajaban en el barco, que pasan a ser testigos protegidos.
▶️ Esto contraviene la legislación nacional e internacional, que requiere pruebas más allá del testimonio de testigos protegidos para poder condenar a un acusado.

En las Canarias se arrestan alrededor de 100 personas cada año:
⭕ ¡casi el 80% de los acusados se declararon culpables!
⭕ ¡quienes se autoinculpan junto con los condenados en el juicio representan el 92%!
⭕ El 30% de los que decidieron luchar por su inocencia en un juicio fueron absueltos.

En el estado español se encarcela sistemáticamente a personas migrantes acusadas:
▶️ de conducir las embarcaciones con las que llegan,
▶️ de asistir en la organización del viaje, por ejemplo arreglando el motor, manejando el GPS o haciendo una llamada de emergencia.

Thus every year hundreds of people are sentenced to heavy prison sentences for participating in their own migration process, often without evidence to prove it. More than half of the defendants are sentenced to 3 years in prison, but some are sentenced to up to 8 years.

The accusation is often based ONLY on the testimony of 1/2 people who were on the boat, who become protected witnesses. This contravenes national and international law, which requires evidence beyond the testimony of protected witnesses in order to convict an accused.
