International and domestic research consistently shows that decriminalisation of sex work is one of the most impactful efforts to reduce HIV transmission, proving that rights-based policy is effective public health. Decriminalising sex work eliminates mandatory STI and HIV testing for sex workers and removes offences that specifically target people living with HIV or other STI. Decriminalisation is backed up by research, like the landmark 2014 The Lancet study, that showed decriminalisation could prevent one-third to nearly half of all new HIV infections among sex workers and clients within a decade.

Decriminalisation of sex work in Australia New South Wales became the first jurisdiction to decriminalise sex work in 1995. Since then, sex work in Australia has also been decriminalised in the Northern Territory (2019), Victoria (2022) and Queensland (2024), marking significant milestones in the national landscape. However, sex workers continue to be impacted by legislative and policy gaps that enable stigma, discrimination and criminalisation. This progress highlights that further action is needed not only to strengthen frameworks in the jurisdictions that have already decriminalised sex work, but also to implement reform in the remaining jurisdictions: the ACT, Western Australia, South Australia, and Tasmania.

The criminalisation of sex work increases the risk of HIV. Research shows that repressive police power over the sex industry was associated with twice the odds of HIV transmission. Here’s what else we know about HIV and decriminalisation: Criminalisation of sex work and licensing create barriers to sexual health prevention, testing and treatment. Mandatory testing reinforces stigma. It incorrectly assumes sex workers won’t engage in safer sex practices unless it’s the law. Decriminalisation contributes to health sector financial savings from fewer HIV cases.

Today we commemorate World AIDS Day and acknowledge those among our community we have lost and those living with HIV. We also reiterate our calls for the full decriminalisation of sex work and recognise its impact as a tool of HIV prevention.
