100%. Drivers are responsible for looking at the road and taking care not to hurt anyone. That's where the legal emphasis should be.

The law should be enforced to improve driver behaviour. Having said that, cyclists and pedestrians would be mad not to take measures to improve their visibility in the dark and at dusk.
