The Tribunal’s ruling sends a clear message: Taliban rule isn’t just oppression—it’s an institutionalized apartheid based on gender.

Afghan women are denied basic rights—from education to freedom of expression.

Rawadari has recently obtained a copy of the “Criminal Procedure Code for Courts” (De Mahakumu Jazaai Osulnama) signed by the Taliban leader, Habatullah Akhundzada, and circulated to the courts at the provincial level across Afghanistan for implementation.

5. Who exactly would be sued: the State of Afghanistan or the Taliban?
YouTube video by Rawadari رواداری 5. Who exactly would be sued: the State of Afghanistan or the Taliban?

The International Court of Justice (ICJ) cases are only between countries—not groups like the Taliban. So the case would be against the State of Afghanistan. However, since the Taliban is the de facto authority, they would be held responsible.

Of the 189 CEDAW members, 150, including Afghanistan, accept ICJ jurisdiction. This means 149 countries can legally bring a case against Afghanistan.

CEDAW creates a shared system where countries hold each other accountable for ending discrimination against women. If a state believes Afghanistan is violating CEDAW, it can bring a case.

4. Who can bring the case under CEDAW against Afghanistan before the ICJ?
YouTube video by Rawadari رواداری 4. Who can bring the case under CEDAW against Afghanistan before the ICJ?

Only governments can bring cases to the ICJ—not individuals or organizations. To take Afghanistan to the ICJ for violating CEDAW, a country must have ratified CEDAW and accepted the Court’s jurisdiction under Article 29.

3. Why can Afghanistan be brought before the ICJ for violations of women’s and girls’ rights?
YouTube video by Rawadari رواداری 3. Why can Afghanistan be brought before the ICJ for violations of women’s and girls’ rights?

Afghanistan is a party to CEDAW, the global treaty protecting women’s and girls’ rights. By accepting Article 29, Afghanistan granted the ICJ authority to hear disputes about violations.

The International Court of Justice (ICJ) is the UN’s highest court, where countries resolve disputes under international law. Based in The Hague, ICJ has 15 judges and issues binding decisions. The Court’s hearings are public and livestreamed, ensuring transparency.

This is result of tireless advocacy by survivors, activists and national and international organizations since May 2021 and following the attack on Sayed u Shuhada school in Kabul. We command the EU for championing this resolution which is a significant and historic step for justice for Afghanistan.
