The officer escaped prosecution for malicious communications because the "evidential" test was not met, despite Ms Gilmer herself saying: "There is no cogent explanation as to anyone else who could have sent these messages from the Instagram account."

This seems to fly in the face of legal precedent.

As one landmark ruling put it, even when press coverage of cases is "painful" or "humiliating" for a person and their family, this is "the price to be paid for open justice and the freedom of the press".

Our appeal against the reporting restriction was rejected by Ms Gilmer.

She refused to explain her reasons but insisted they "do go beyond embarrassment to the officer and, in my judgement as chair, would have led to catastrophic impact on family members of the officer".

The decision to anonymise "Officer Y" was taken by assistant chief constable Jenny Gilmer, who chaired his misconduct hearing.
