They need the setback variance to fit a transformer in the back/the back of the building expanded into an area it hadn't previously after they moved things around to hide the 5th story.
Re: demand:
Planning board *can* grant or deny the variance, it's technically their discretion.

If you read the article, it's a what happens when a commercial zone is next to a residential zone. Nothing more.
"Because the rear of the property is next to a residential district, the setback is 20 feet. If the property was next to anything else, there would have been no setback requirement."

The chairman was complaining that he would need to pull permits because on the higher stories the building would overhang the sidewalk, that it was too much stuffed in, but also, the overhang wasn't in their purview/something they could use to deny the permit.
