Ellis highlights the attacks Reverend David Black has suffered at the Broadview facility, finding plaintiffs have sufficiently alleged that the feds' use of force against praying people "substantially burdens their excercise of religion."

Ellis says the order will direct "agents and officers to follow the training they've already received... and is essentially directing them to follow their own rules, policies, regulations... and the behavior that the constitution demands."

Ellis says the govt has asked the court to stay the restraining order pending appeal.

As of Sept. 30, 128 service members have been investigated following Kirk's death, and most of those cases are still under review, according to documents reviewed by The Post. Two have been "removed from employment." The status of the remaining civilians or contractors was not immediately clear. In addition, five former Defense Department employees have been placed under investigation, the documents show.
