I dunno… hauling people to El Salvador without due process, teasing a third term despite the 22nd Amendment, and calling for the impeachment of judges because you don’t like their rulings do not seem like uses of legitimate presidential power.

First, the Court has pretty high support across the board. But second, Republicans agreed with the statement more than Democrats and, notably, Trump voters agreed with the statement more than non-Trump voters. Both of these differences are statistically significant (p<0.01).

The citizenship clause was added to the 14th Amendment in the Senate in 1866. Senator Jacob Howard introduced the final version and shepherded it to passage. Here's Eric Foner's "Second Founding: The Second Founding: How the Civil War and Reconstruction Remade the Constitution." (2019)

The citizenship clause was put in the 14th Amend to specifically overturn the Dred Scott decision (1857), which claimed that Black Americans were not citizens. Congress still could have put some restrictions on it. But they choose not to. They choose to establish universal birthright citizenship.

Teaching Bruen and Rahimi today. Looking forward to explaining to students why surety laws are a historical analogue for statutes disarming people who are subject to domestic violence restraining orders but not a historical analogue for may-issue public carry license schemes.

Texas Senators could be recalled under new proposal
Texas House Republican Brian Harrison said the proposal would "ensure our U.S. senators serve the best interest of the State of Texas."
The Articles allowed for states to recall their congrsssional delegates if they didn’t like what they were doing, but the framers of the Constitution decided not to include such a provision in the US Constitution. It’s not like nobody thought of it at the time.

Interview with Judge Ho:
“Birthright citizenship is supported by various Supreme Court opinions, both unanimous and separate opinions involving Justices Scalia, Thomas, Alito, and others. But birthright citizenship obviously doesn't apply in case of war or invasion. No one to my knowledge has ever argued that the children of invading aliens are entitled to birthright citizenship. And I can't imagine what the legal argument for that would be. It's like the debate over unlawful combatants after 9/11. Everyone agrees that birthright citizenship doesn't apply to the children of lawful combatants. And it's hard to see anyone arguing that unlawful combatants should be treated more favorably than lawful combatants”
So actually Judge (maybe future Justice) Ho has found a way around his previous support of birthright citizenship as a constitutional guarantee. Turns out illegally crossing the border is “invasion” and your children have no citizenship rights.
It’s nonsense. But this is going to be the argument.

There is no crime that a child can commit which would justify putting them in an adult prison.

The Trump Campaign Wants Everyone Talking About Race
The former president and his advisers’ strategy is to make white voters afraid—and they don’t care if they have to lie to do it.
"Ashley Jardina distinguishes between a politics of racism and white identity. Some white voters who are not opposed to stronger social-welfare policies in general can be manipulated by appeals to the sense that white people as a group are threatened." www.theatlantic.com/politics/arc...

Mr. Frank is the author of “What’s the Matter With Kansas?” among other books.
Everyone has a moment when they first realized that Donald Trump might well return, and here is mine. It was back in March, during a visit to the Smithsonian’s National Portrait Gallery, when I happened to read the explanatory text beside an old painting. This note described the westward advance of the United States in the 19th century as “settler colonialism.” I read it and I knew instantly where this nation was going.
Good news, everyone. There is no need for further punditry. We have the Woke National Portrait Gallery Theory of the 2024 election. Read it and educate yourself
