Chapman again claims that Grusch's complaint lacks legal merit and should be dismissed as Virginia's VFOIA law only permits injunctions, not damages, and that his office acted lawfully when they released the report to Ken Klippenstein at The Intercept.

Grusch once again argues Virginia law allows implied damages and that Sheriff Chapman’s immunity defense is invalid. He also asserts that the release of his incident report was illegal and says Chapman is liable for his employee’s actions.

Trial is scheduled for June 2nd, but there is a February 19th hearing set for the judge to consider Chapman's request to dismiss the lawsuit altogether.
