On 25 April the Equality and Human Rights Commission announced that it would undertake a public consultation on updates made to its statutory Code of Practice for services, public functions and associations, following the Supreme Court’s judgment in For Women Scotland v Scottish Ministers.

In light of the level of public interest, as well as representations from stakeholders in Parliament and civil society, the consultation period has been extended.

The following arrangements have now been confirmed: 

The consultation will aim to launch 19 May and close on 30 June 2025.
The consultation will focus on sections of the Code of Practice that required updating following the Supreme Court’s judgment. A draft of the full Code of Practice was consulted on between October 2024 and January 2025.
The consultation will seek views on whether these updates clearly articulate the practical implications of the judgment and enable those who will use the Code to understand, and comply with, the Equality Act 2010. The Supreme Court made the legal position on the definition of sex clear, so the EHRC is not seeking views on those legal aspects.
While the consultation is running, the EHRC will hold Q&A sessions with stakeholders representing affected protected characteristic groups. These meetings aim to answer questions on the EHRC’s understanding of the Supreme Court’s judgment, the consultation process, where views are being sought and what can and cannot be changed in the draft Code of Practice. Participants will still need to submit a consultation response. The EHRC will also meet with governments from across Britain and hold informative briefings for Parliamentarians.
The EHRC will review responses received as part of the consultation and make necessary amendments to the Code of Practice. It will then be submitted to the Minister for Women and Equalities for approval and laying in Parliament.

- Will male police officers now have powers to strip search any woman they suspect as being trans?
- What does 'biological sex' mean? Is it 1. what's on your birth certificate? 2. one's genitals? 3. hormonal? 4. chromosomes? 5. A combination of all of these?
- If 1. will we all now have to carry our birth certificates around with us and present them every time we wish to urinate? If 2. Will we have to present our genitals for inspection? (in which case some trans women have vaginas)? If 3. Will we have to take a 'gender test' similar to that undergone by elite athletes? If 4. How will that be measured?
- If the answer is 5 - where will intersex people go? What is deemed to be the 'correct' balance of female hormones? Will cis women with naturally high testosterone be allowed to use single sex spaces? What about cis women who are post-menopausal?
- Where are trans men supposed to go if they need a single sex space? I cannot imagine the gender critical campaigners behind the Supreme Court decision would be comfortable sharing with people who are indistinguishable in almost every way from cis men (and trans men would certainly not want to do that either).
And finally if, as I suspect, all of the answers to my questions above conspire to create a situation where womanhood is a tightly gatekept thing, accessible only to those who meet strict criteria, and everyone else is labelled 'not woman' - How is that a win for feminism?

I've written to British Transport Police asking for clarity on the specific changes they've made to their policy following the Supreme Court ruling.

With EHRC guidance still pending, it's vital we understand how these decisions were made and what they mean in practice.
