Fuck 'em. They have too much damn power. Just like in your proposal, mine makes the Circuit Courts of Appeal into the final appellate authority in most cases. But I do think it would encourage compromise: any president who wanted to influence the court will avoid appointing such a malicious actor.

Decisions on cert applications should be unanimous. No more conservative "let's rewrite the law" purpose-designed impact cases. No shadow injunctions without a grant of cert, except to require that appropriated funds be spent or federal contracts be honored.

It's a whole mindset. As a housing lawyer I've been dealing with it for years: free market theory says rent control is bad, so when the studies and evidence show overwhelming benefits, the studies and the facts must be wrong. Never challenge the underpinnings of someone's religion.

The method they use is to take on designer litigation invented in right wing think tanks. We need to strip their jurisdiction to take on these type of cases: cert should be granted only on a unanimous vote, and no injunction granted absent a grant of certiorari.

I don't agree with the premise of your question. I don't know of a good example of the right wing canceling someone for "saying heinous shit." And if it's heinous, it's probably not the product of empathy.

The framing of that question is the failure of conservatism, in a nutshell. The real question is what has OUR empathy gotten US? The answer: everything. All of civilization & its accomplishments is rooted in deriving universal principles of ethics and conduct from our individual experiences.

They are angry because they haven't yet come to understand that the destruction and havoc they have wrought have not made them any better off. It's a cycle that will only end with their demoralization and defeat.

The question is whether Democratic voters have any actual influence over the Democratic party. The treatment of Mamdani demonstrates that the answer is "no."
