EU rollback on environmental policy is gaining momentum, warn campaigners
Observers shocked at scale and speed of deregulation drive they say is watering down European Green Deal and laws
Saying it like it is when we talk about #deregulation:

So, what's next?
Well first the General Affairs Council (ministers from member states) may or may not publicly endorse the agreement. They're in a meeting as I type.
But mostly, the EU Parliament needs to negotiate its position. And we need to make it clear they can't mess this up like others did.

5️⃣Last but not least, Council is proposing to delay the law's transpition deadline by a further year - after it was already postponed three months ago.
Nevermind the urgency of the climate crisis, nor the life-or-death situation faced by some victims of corporate abuse.

This is the second time the CS3D personal scope is narrowed.
For most of the original negotiations, about 16k companies would have been covered. As adopted in 2024, about 3400 corporate groups are covered. Now it could be just 1000.

4️⃣Council proposes to further reduce the amount of companies covered by CS3D. Companies would now be in scope only if they fulfill the following criteria.
>5000 employees
>€1.5B yearly turnover
This leaves roughly a thousand companies in scope.

Well, the Council basically decided to Frankenstein the whole thing: risk-based approach, but only on direct business relationships.

The Commission decided to go against that, and to borrow from the German Supply Chain Act: due diligence obligations would only extend to direct business relationships, unless "plausible information" would be available to the companies that violations were occurring deeper in the value chain.

3️⃣ CS3D originally required for companies to take a risk-based approach to their due diligence requirements. In plain English, look at where the risk of violations is higher (depending on countries, sectors, etc) and focus on that first.

This really endangers access to justice for victims of corporate abuse. Instead of a single regime, they could be facing 27 different potential regimes - and this opens the door for large multinationals to be regime-shopping.
A clear loss for swift and fair justice.

2️⃣CS3D's unified civil liability regime was already under attack in the Commission's proposal.
The Council, despite original push back from countries like France, Denmark, Spain or the Netherlands (non-exhaustive) is aligning with the Commission's proposal.

These design elements in CS3D as adopted in July 2024: "intermediate and 2050 climate neutrality targets, and where relevant, the exposure of the company to coal-, oil- and gas-related activities."

For anyone catching up, Omnibus 1 is the first of a series of deregulation packages attacking a variety of legislations secured under the previous commission's mandate.
It's widely seen as the canary in the coal mine for the survival of the European Green Deal.
