If I want to completely ban all transphobes from my Minecraft server, then it is my right to do so, in the same vein, if someone else wants to make their own server, on their own hardware, that does not have any rules, that is their right. Mojang should not infringe on that.

Good point, people should not assume that control will not come your way just because it happens to someone else first. Mojang should not be in any position to tell third party server owners what to do, save for prohibiting gambling and or pay-to-win. If they don't host it, they don't moderate it.
