FWIW I asked Rick Hendrick yesterday about being on the witness list and he said he had not been notified of that yet. He said he hoped the case gets settled but did not know if it would.

Judge Bell has granted the motion by 23XI and Front Row to depose Rick Hendrick and Roger Penske prior to the trial as they are on the NASCAR witness list and, according to 23XI/FRM, they were designated as witnesses after the discovery deadline.

Jimmie Johnson announced his intention to run in the Cup race at San Diego (near his hometown) next year. Not immediately clear if he will ask for an Open exemption spot that would guarantee him a spot in the field.

NASCAR statement on the ruling today that defined the market as premier stock-car racing. NASCAR felt that was too narrow a market definition.

Judge Bell: "NASCAR made a strategic decision in asserting its Counterclaim and must now live with the consequences. ... NASCAR wants to (but cannot) have it differently on each side of the same coin – heads we win, tails you lose."

The judge said b/c NASCAR's counterclaim identified the market as "the market for entry of cars into NASCAR Cup Series races in the United States and any other location where a Cup Series race is held" that NASCAR couldn't say that's not the market for the 23XI/FRM allegations.
