It would be odd to me that they’d cite a case supporting jailing someone for handing out anti-war pamphlets as justification for false public alarms. The point of the metaphor was to claim saying β€œHey, war is bad, mmmkay?” is *as dangerous* as falsely causing a panic, justifying laws against it.
