This is why it’s good that precedent evolved from “this speech expresses ideas some people claim is abstractly harmful” to “this speech has caused actual, immediate, criminal action and was intended to do so”.

It would be odd to me that they’d cite a case supporting jailing someone for handing out anti-war pamphlets as justification for false public alarms. The point of the metaphor was to claim saying “Hey, war is bad, mmmkay?” is *as dangerous* as falsely causing a panic, justifying laws against it.
