we were told that one of the defences against Presidential tyranny in the US is that the US military will refuse to follow unlawful orders.
and then asking:
can we now say that that isn't a real protection because surely the orders here are unlawful?

No.

Members of the US military (and the New Zealand military and British military etc.) are expected to refuse to follow manifestly unlawful orders.
It is a category error(?) to assume this means that eg each member of the military must themselves assess whether the invasion of Iraq was justified.

I am disputing that the orders - 'bomb this military target' - are illegal even if the war itself is illegal.

The service personnel involved in these strikes are not all committing crimes by being involved, even if the war is unlawful.

That's a question about the President, not the sailors(?) involved in this strike, who are not declaring war.

The legal standard for refusing to follow orders is if they are manifestly unlawful.
