Labour did similar with their bill to allow more frequent switching of electoral rolls, took it to SC on a bare majority, then made a deal with National before committee of the whole because of the entrenchment angle.

I had interpreted your post as basically saying:
we were told that one of the defences against Presidential tyranny in the US is that the US military will refuse to follow unlawful orders.
and then asking:
can we now say that that isn't a real protection because surely the orders here are unlawful?

Members of the US military (and the New Zealand military and British military etc.) are expected to refuse to follow manifestly unlawful orders.
It is a category error(?) to assume this means that eg each member of the military must themselves assess whether the invasion of Iraq was justified.

I am disputing that the orders - 'bomb this military target' - are illegal even if the war itself is illegal.

I feel like there have long been operation names. Overlord. Market Garden. Barbarossa. Rolling Thunder.
This is maybe worse, but of a kind.
Gravestones a different matter.

Bombing a military target does not by itself involve the commission of a crime by military personnel even if the war is illegal.

Basically, a manifestly unlawful order is one you could be prosecuted for following.
The service personnel involved in these strikes are not all committing crimes by being involved, even if the war is unlawful.

That's a question about the President, not the sailors(?) involved in this strike, who are not declaring war.

The legal standard for refusing to follow orders is if they are manifestly unlawful.

The best part of that story is that it ended up opening a new line of business and made the company money in the end:

At the risk of being yelled at, this is actually perfectly OK advice. As long as the long outfall is functioning, it discharges well into Cook Strait & there's basically no elevated risk close to shore off the south coast. The reason one needs to check is in case the short outfall has been used.

I was once involved in a case which we took though the New Zealand High Court and Court of Appeal and then an application for leave (cert) in the Supreme Court before the client's mother pointed out his name was spelled wrong (I had copied it from some Police charging document).

for Season 6 Premier the cast were scheduled to appear on CBS' The Early Show and The Rosie O'Donnell Show on September 11, 2001; due to the terrorist attacks, the latter was cancelled, and the cast remained at their hotel in New York. Romano later stated that in the afternoon the cast went for a walk in Central Park and met someone who had been at the World Trade Center and was unable to get home so they decided to take them back to the hotel gave them a room and invited them to dine with them that evening.
somebody out there survived the 9/11 terrorist attacks and then bumped into the cast of Everybody Loves Raymond in Central Park

(One of the reasons I've been quite disappointed with some people on the left who've been pretty uncritically promoting LLM submission tools. Sure they might be empowering to some individual submitters, collectively they dilute genuine voice and disempower communities)
