Allowing the state to kill an armed civilian absent a clear, immediate, and articulable threat collapses the Second Amendment into a privilege granted only to those the government approves of. If the right to bear arms does not protect dissenters in contested spaces, then it is not a right at all.

If Kyle Rittenhouse’s armed presence in a volatile protest environment was not considered provocation and his fear required careful legal scrutiny, then federal agents’ fear must be held to at least the same standard.

A consistent pro–Second Amendment position would acknowledge that Alex had a constitutional right to carry a firearm, that merely being armed at a protest does not constitute a threat, and that rights do not disappear because law enforcement feels uncomfortable.
