The entire country is walking on eggshells because a madman is hallucinating about crime sprees and burning cities.

It seems clear—I think to everyone, now—that a false and illegal invocation of the Insurrection Act is coming before the end of the year. Media outlets should be telling us how they will prepare for this potential Treason. State governments should be telling us. Activists should be developing plans.

A small problem with Bluesky is that there is a critical mass of users who miss Twitter because they want to yell at those who disagree with them and be combative with people in power, but absent that, they decide to nitpick with their allies and making annoyingly obvious comments to feel something.

Please to share the final, citable version of my latest article, The Existential Challenge to the Administrative State, forthcoming in the Georgetown Law Journal. Written mostly before Trump's second term, the paper critiques and responds to the case law that has enabled the current conflagration.

It bears repeating again and again. (1) Drug trafficking is not a capital offense even under American law on our shores (2) These civilians have been alleged to commit crimes (3) All accused persons are entitled to due process and the have evidence presented in courts of law.

We are not barbarians.

The president does not have this power. He’s acting unconstitutionally to commit crimes against humanity— murder on the high seas.

Lest it be forgotten, the president may be immune re: official acts (assuming these are), but subordinates committing extrajudicial executions are not so entitled.

This is like planting evidence and then making an arrest.

Just for everyone’s benefit: No, quite the contrary. It may only be about enforcing federal law, which under 12406(3) does not qualify for an exception to Posse Comitatus. There is no insurrection or rebellion.

I strongly object to the comparison many are making these days between Stephen Miller and Joseph Goebbels.

I think it's deeply misguided, and unfair, to compare them.

Goebbels was a far better propagandist, and didn't execute much policy.

Miller far more closely resembles Heinrich Himmler.
