Hey Jenn โ I hear you. I voted for the audit, and I believe the Legislature can be audited. But there are limits set by law, and those limits protect the separation of powers that we all have to follow. My office can certify a ballot question and there can still be constitutional issues โ Iโve said that from the beginning. Under state law, a ballot measure does not have to be constitutional in order for my office to certify it. (Iโd certainly welcome a change to that process!) Thatโs why challenges can arise during implementation (this has happened before with ballots like Right to Repair and Cage Free Chicken/Pigs), and why itโs so important for us to get the Auditorโs answers to these questions. The law โ as set forth in G.L. c. 12, ยง 3 and cases like Secretary of Administration and Finance v. Attorney General (1974) โ does not allow the State Auditor to bring litigation first and address these issues later.
Q: What laws are impeding the audit?

Hey Josh โ I voted for the audit and I believe the Legislature can be audited. When my office certifies ballot questions, we are legally required to follow a specific process laid out in Article 48 of the Massachusetts Constitution. Unfortunately, that process does not allow my office to take into consideration other constitutional limitations that may apply to certain ballot questions. (Iโd certainly welcome a change to that process!) Thatโs why challenges can arise during implementation (this has happened before with ballots like Right to Repair and Cage Free Chicken/Pigs), and why itโs so important for us to get the Auditorโs answers to these questions about the constitutionality issues.
Q: How can a ballot measure pass and still have constitutional limitations?

Hey Nancy- Nobodyโs powers are absolute and its critical the Auditor can provide a clear explanation of what she views her authority to be. The Auditor has the authority to conduct audits, but thereโs a legal process that to be followed when one branch of government sues another. Weโre working to get clarity so the courts can decide the details of the audit.
Q: Why isnโt an audit unlimited?
A:
Hi Larry - The Legislature can be audited. I voted for it. But there are limits set the state constitution, including Articles 21 and 30 of the Massachusetts Declaration of Rights and Chapter 1 of Part II of the Massachusetts Constitution. Before we can ask a court to decide what those limits are in this context, the Auditor needs to share her position. Sheโs not yet done that because her political position that sheโs entitled to audit everything does not have legal support. .
Q: Can you provide citations?

Hey John- We are working with the lawyers in her office. The questions regarding legal boundaries are similar to questions her office has answered before for other lawsuits - we have worked with her team in the past. They are also the questions the court will ask her.

Hey Kevin - My office has provided clear guidance to the Auditorโs team on what answers she has to provide to move forward lawfully- similar questions she has previously answered for other lawsuits we have helped her with. My team will continue to offer to sit down and discuss with her. Weโve been consistent with this approach - if the process hasnโt been expedited, itโs not because of my office.

Hey Ed- My team has reached out to her staff with guidance and offered to sit down and talk it out. As soon as she responds, we can move forward and this issue can be taken to the court. Hey Jonathan- Weโve been direct with her office about the answers we need. In fact, sheโs answered similar questions on other lawsuits my office has helped her bring forward, so she is familiar with this process. The Auditorโs request for an outside lawyer is still pending, and weโre ready to move it forward once her office provides this basic information.

Hey Vincent - Good question. My team has repeatedly reached out to the Auditorโs office with clear communication on the questions she needs to answer for the audit to move forward. She has answered similar questions for previous lawsuits- itโs not new information or a new process. Yesterday, my team sent her another letter outlining the information we need and offering to discuss. Once she responds, we can move forward and let the courts decide the details of the audit.
