Glad that Mothers Day is almost over. I’m ready for a regular day, even a Monday, where there are no unexpressed and unmet expectations. Thing is, tomorrow is my dead mom’s birthday. Maybe I can at least hide and cry somewhere?

There are usually restrictions written into their plans on what time they can start but I n my experience, they could care less. My husband knows how to find such plans and who to complain to, and has, but they do it anyways. I hate it.

ID SB 1166 is an example of the horrible legislation coming out of our legislature. It hurts people, is specifically vindictive, and worsens an existing issue instead of offering a solution. I hate it here.

Why pursue already unconstitutional practices?

The sponsors of SB 1166 are from Meridian and Eagle. I know they both take their Christian faith seriously as well as being constitutional conservatives. /20

SCOTUS has expressly rejected requirements requiring the written consent of two-thirds of residential property owners living within 400 feet of “philanthropic home for children or for old people” to authorize its construction as being “is arbitrary and repugnant to the due process clause”. /19

SB 1166 constitutes a neighbor veto by allowing shelters only with the written consent of neighbors. This has long been prohibited by the courts. /18

In fact, Idaho Code 67-6519 presumes that applicants, upon denial, will return with an improved application since the denying jurisdiction is required to inform them of what can be done to obtain approval. Why deny due process? /17

SB 1166 prohibits an applicant who has had an application for shelter rejected from even modifying and applying its application for 10 years. There is no other provision of the Local Land Use Planning Act with such a prohibition. /16

SB 1166 targets individuals and families who are homeless in violation of multiple state and federal laws, including the Federal Fair Housing Act, Religious Land Use and Institutional Persons Act, and Religious Freedom Restoration Act, as well as Idaho’s Religious Freedom Restoration Act. /13

Moreover, it is not applicable only to residential zones but also to “exclusive detached residential use” within other zones. If “protection” is required, then why only protect detached single family residences, why not all residential uses including apartments, duplexes, attached ADUs, /11

Boise City rejected this requested setback for sound planning reasons. Why should the legislature overrule it?

SB 1166 lacks any rational basis for protecting people from homeless shelters as the 300 foot setback in SB 1166 is not established statewide. /10

“if you enact such a setback, there’ll be nowhere in the city where [shelter] can be built . . . we already have such a limited footprint where [shelters] are permitted . . . that we’d have no place in the city to – build such a thing.” /9

Shelters are only permitted in Boise in four commercial zones. When asked by the Boise City Council about this proposed setback during an April 21, 2022 hearing on Interfaith, Boise Planning Director Tim Keene noted /8

in the first draft of the rewritten Boise City code in 2021, several years before it was adopted. However, based upon input from the citizen advisory committee and Boise City staff, it was removed and eliminated in all future drafts. Why? /7

with populations greater than 100,000, was forwarded to the floor. Where are the homeless to go in Idaho’s largest cities?

In truth, a 300 foot setback to residential uses was included /6

SB 1166, regulates the siting of homeless shelters and services only in cities with populations greater than 100,000 (only Boise, Meridian, and Nampa). It was introduced at the same hearing where SB 1141, which prohibits camping by homeless only in cities /5

and that a 300 foot setback “was recommended by a consultant regarding the rezoning of Boise”. None of those statements are accurate. /4

SB 1166 circumvents the City of Boise’s support for shelter and transitional housing.

The sponsor of SB 1166 stated that it is a bill “related to commercial zoning requirements”, that it would “create uniformity”, that it will “ensure that these areas are sited responsibly” /3

“For the past four years, I have represented Interfaith Sanctuary in attempting to redevelop the former Salvation Army facility on State Street to provide shelter to the homeless, as well as supportive services, job training, family housing, and care of the medically fragile. /2
