Not sure who needs to hear this, but the Insurrection Act isn’t the same as β€œmartial law.” It authorizes the molitary to engage in civil law enforcement. And not clear that even then, whether they can enforce state criminal laws

FWIW, I see this order as a very encouraging sign for those who are hoping #SCOTUS *denies* the Trump administration’s application.

There would be no need to issue it if the administration had five votes on the other two issues; and this is perhaps the strongest argument against it on the third.

You may have heard that the Dems walked out of the Sen Judiciary committee hearing on Bove but not why. It's because Chairman Grassley moved to a vote without allowing all the Dems to speak.

We simply cannot allow the world's most powerful antisemites to continue pretending they care about the safety or freedom of American Jews. They don't give a fuck about us, and no one should act like they do.

Escalate and intimidate. That is exactly the playbook.

And it concerns me greatly: You know the Stephen Miller types in this administration are just itching for violence - searching, longing for something they can use as pretext for a drastic escalation so they can finally ditch all restraint.

Trump's dismantlement of the Civil Rights Division, and its transformation of the rump that remains into a right-wing grievance engine, was a big motivator for my newsletter last week arging for the importance of the private plaintiffs' bar. buttondown.com/sbagen/archi...

Switching from ICE to DoD Custody: An Alarming Violation of Court Order on Deportations to El Salvador Earlier today, I discussed one of the β€œsleeper” immigration cases that had largely flown below the radar: D.V.D.

I just wrote: "Switching from ICE to DoD Custody: An Alarming Violation of Court Order on Deportations to El Salvador"

Astonishing.

Read ICE official's affidavit. ICE had the detainees in their custody before turning them over to DOD for transfer to torture in El Salvador. AFTER court issued TRO.

Extra: John Roberts Sure Isn’t Going to Ensure This Supreme Court Saves Us After All Due process is super simple and accessible for detainees being disappeared by the government, apparently.

with @mjsdc.bsky.social on the Roberts Court giving the Trump Admin just about everything it needs to keep renditioning people without due process

The Government's Admissions In The District Court Are Appropriately Before This Court
Also for the first time in reply-and perhaps, for the first time in any Government
brief to this Court β€” the Government impugns its own counsel, whose candor the district court commended, for making admissions that purportedly "did not and do not reflect the position of the United States." Reply at 5. But the Government, like any litigant,
cannot disavow the concessions of its own counsel-especially when it does not even contend that anything about them is factually untrue. See United States v. Yildiz, 355 F.3d 80, 82 (2d Cir. 2004) ("[The government's attorneys can bind the government with their in-court statements." (citations omitted)); see also Magallanes-Damian v. INS, 783
F.2d 931, 934 (9th Cir. 1986) (party is bound by its counsel's in-court admissions "absent egregious circumstances"). Courts would cease to function if they could no longer rely
on concessions by counsel at oral argument. There is no basis for the Government to
withdraw the good-faith admissions of its experienced agent simply because it now finds
them inconvenient.

Lawyers for Kilmar Abrego Garciaβ€”the man illegally sent to a Salvadoran prison due to the government’s own errorβ€”say the Justice Department can’t disavow the admissions its lawyers made in court. (DOJ suspended the lawyers for, in part, just telling the truth.) www.supremecourt.gov/DocketPDF/24...

Musk explicitly says he wants to turn America into El Salvador where a strongman has consolidated power, undermined judicial independence, harassed journalists, and suspended constitutional rights

Dear Internet:

#SCOTUS holding that the President can't be prosecuted for official acts does *not* mean, under *any* non-frivolous reading, that the *federal government,* including all of its officers, is immune from civil suits for *its* official acts.

There's just no equivalency between the two.

Legacy Status and the End of Affirmative Action It’s easy to understand why minority students would be up in arms over the Supreme Court’s decision to end affirmative action, while permitting practices like legacy-based admissions to continue. ...

I wrote about the legal details you should know about, as students begin to tee-up claims that if affirmative action can't be a thing, legacy admissions can't be either. Civil Discourse: https://joycevance.substack.com/p/legacy-status-and-the-end-of-affirmative
