Avant cette date je ne connais qu'une décision relative à l'article 6.I.4 de la LCEN, un arrêt de la CA Paris du 15 décembre 2010 (n° 10/05248). Il s'agissait d'une action pénale, la cour avait considéré qu'il n'y avait pas d'intention de commettre un délit.
