Our new analysis finds court reform would check SCOTUS as a facilitator of autocracy, while preserving litigation as a tool to fight back: peoplesparity.org/research/no-...

I don't know when or how it will come, but there will be a moment when Trump's presidency is behind us and we're picking up the pieces of our democracy.
That can't be the first time we think about how we rebuild; that planning has to start now. Deep, structural court reform must be a part of it.

dismantling democracy. There will be no path out if we don’t enact court reform.

The rise of the shadow docket—the Court’s preferred tool for issuing massive rulings with little or no briefing, argument, or explanation—is just the latest manifestation of this intellectual laziness.

Brett Kavanaugh’s Lazy Racial Profiling Opinion Is the Most Honest Originalism He’s Ever Done
There is a long, grim history of Supreme Court justices deciding big cases by appealing to what they think feels right.
SCOTUS is just vibes now
@skennedy2504.bsky.social in @ballsandstrikes.org "...Kavanaugh instinctively replicates the form & reasoning of early Marshall Court decisions: assumptions in search of authority, conclusions without argument, & outcomes he frames as self-evidently reasonable & correct."

The courts will not save us. And even when they try, our thoroughly corrupt SCOTUS steps in to urgently intervene on behalf of the President. SCOTUS belongs to Trump now. We must demand serious court reform to protect our democracy from the naked corruption that has captured the highest court.

Supreme Court pulls trigger on FTC firing, siding with Trump over precedent
Democratic Commissioner Rebecca Slaughter argued that the high court's emergency docket wasn’t the appropriate forum to overturn nearly a century of precedent.
SCOTUS handed down another emergency shadow docket decision that concentrates power in the hands of the president. They're giving more and more power to Donald Trump—power that they know he'll use to further dismantle democracy.

Perkins Coie Fires Lawyer Over This Charlie Kirk Post - Above the Law
Why would the firm choose to terminate a valued associate over something so benign?
Perkins Coie stood up to Trump’s Big Law extortion attempt, but it seems we've found the limit to their courage. If Perkins Coie is willing to fire attorneys for speaking the truth while decrying gun violence, it's clear they are more committed to their bottom line than they are to democracy.

Sen. Blumenthal, Rep. Johnson Reintroduce Legislation to Restore Access to Justice
The FAIR Act would end corporations’ use of forced arbitration and give cheated consumers, workers, and small-business owners their day in court.
⚖️Through forced arbitration, employers & corporations have created a private system of justice where the constitutionally created protections of our legal system don't apply. That’s why consumers, workers, and small biz need the #FAIRAct @consumeradvocates.bsky.social

How the Supreme Court Turned Trump Into a Danger to Everyone
The administration’s decision to launch an attack against alleged drug runners in the Caribbean is a lawless act—or at least it used to be.
The court has, in effect, created a special legal zone around the presidency—as well as executive agents writ large—in which actions, even when blatantly illegal, are immunized from consequences: @skennedy2504.bsky.social in @newrepublic.com

The Secret Curriculum That Rewired America’s Judges
For decades, big business-funded economics courses have been pushing the nation’s judges to the right.
👉 A new study reveals that between 1976 and 1999, nearly half of U.S. federal judges took economics courses at a conservative institute - which shaped how they behaved on the bench: more pro-business rulings and harsher sentences.

State Courts Hold the Power to Free Us Or Erase Us
State supreme courts decide abortion, protest, custody and LGBTQ+ rights—critical battlegrounds for women, democracy and grassroots power.
🏦State courts handle ~95% of all US legal cases, but have long been overlooked in the fight for democracy & justice. In their recent OpEd in @msmagazine.com, Mercedes Fulbright & Sandra Castro Solís at @repower.org say it's time "to treat state courts not as a footnote, but as a headline.”
