🤔Senate Republicans just voted to sideline their own wartime powers. Now a conservative Supreme Court could finish the job, striking down the law that limits Trump's ability to wage a war with virtually no limits.

It’s worth emphasizing that the Supreme Court has propped up this presidential lawlessness.
When Congress enacted limits on presidential power in 1973, it included an enforcement provision. If the president said there’s an “emergency from attack” and Congress disagreed, it could order troops home.
2/2 In Trump v. CASA, the Court’s conservatives were all too happy to prohibit universal injunctions when it served their political agenda. Now, “Kavanaugh’s complaints about the “mess” caused by lawless executive action sound less like prudence and more like selective amnesia.” 🏛️🧠

❌👑The greatest threat to American democracy is not from armies abroad or international threats, it is from constitutional erosion within. The tried and true anecdote? We must use our voices, our vote and our streets to demand that our constitution belongs to US. #NoKings

🚨🚨Future lawyers, take note: In this moment of constitutional crisis, the path you take has never been more important. You can use your law degree to defend the rule of law & hold power accountable - or you can use it to protect the status quo. The choice is yours.

In his 1st year back, Trump has attempted to dismantle the checks & balances that have sustained American democracy for 250 years — silencing journalists, weaponizing the DOJ, defying federal judges, bypassing Congress & killing people without accountability.

Judges often describe the courts as the last line of defense for constitutional democracy. But a last line of defense that declines to defend is not neutral. It is complicit.

I wrote this piece about popular constitutionalism last year, but I truly don't think I could have possibly imagined then that we'd be watching the people claim power over the Constitution like we have for the last few months in Minnesota.

*If* the federal government actually retreats in Minnesota, I will never, ever let anybody forget that it was the people, not the courts, that made them do it.

Power concedes nothing without a fight. The news of the draw down this morning is a development that was won by the power of neighbors joining together to keep each other safe. We celebrate the wins.
Yet we know the threat is not over, and so our fight is not over.
Another federal court has rejected the administration’s attempt to detain people incommunicado. The Constitution does not disappear inside immigration detention. 👇
