Please help us fund this case and defend EU citizensβ right to travel and return home.
Weβve tried persuasion for years: letters, evidence to Parliament, committees, meetings.
Nothing has changed.
So now, weβre going to court.
The governmentβs position isnβt just cruel - we believe itβs unlawful.
The Withdrawal Agreement is clear: people with a pending application should be able to return to the UK.
One person told us:
βI have nightmares all the time. I dream Iβm watching the plane leave β and thereβs nothing I can do.β
This is the human cost of delay.
Nearly 80,000 people are affected.
Many are separated from family, unable to attend funerals, care for elderly relatives, or deal with emergencies abroad.
2/ If youβve applied to the EUSS and are still waiting, the Home Office says you shouldnβt leave the UK - because you might not be allowed back in.
This can last years.

Children under 18, and family members/joining family members can't benefit from automation either. It's only EEA & Swiss citizens, who arrived before Dec 2020, and are over 18.

The system that we all rely on to prove our immigration status in the UK...is down right now.
There is no alternative, no physical back-up, so no way of showing your employer, your landlord, or anyone else that you have the right to live here.
This heartbreaking situation highlights the urgent need for the Home Office to recognise the disproportionate impact the eVisa system has on older and vulnerable people. Technology is failing many people like Liudmyla when they need it most.

This is what happens when the border is being pushed out and people have no physical proof of their rights.

How the calculator works You enter the date you first arrived in the UK and all the dates you were absent from the UK in the last 5 years (and any planned future absences). It shows you if the total absence is less than 30 months in the last 60 months. If the total absence is more than 30 months (or if youβve not been resident for at least 5 years), it will tell you the future date when you may be eligible.
The new absence rules for pre-settled status holders have come in: people are eligible for settled status if they have been resident in the UK for 30 months out of the last 60 months. Use our absence calculator to figure out how many absences you've had:
