The size of the court's membership is set by statute: 28 USC 1. Amending it needs to be the top priority the next time the Democrats have a trifecta.

I'm skeptical even of that method, and waiting to try it will cost at least two years.

I really have trouble seeing how Packing the Court, followed by a series of judicial disqualification reforms (I have specific ideas!), is not the necessary first step for everything else.

I agree. At this point, court packing and any reform of the current system on any dimension go hand-in-hand.

But the necessity of court packing needs to expressly come up with every statutory reform proposal, though, because they are all doomed without it and statutes are the "easy option."

We are going to see so much more of this. Walz, a white Midwestern guy, will make them have to try to attack him "on the merits."

The problem being that GOP policy is broadly unpopular when explained on the merits, especially when it comes to things like this.

And not just if you're a con law person. This passage is true for EVERY class.

The criminal code or caselaw isn't "the law" of crim, given cops don't have to make arrests (or can make flimsy claims), DAs don't have to charge (or can plea around bad police work), etc. etc.
