Lower federal courts have indeed been (for the most part) stalwart in upholding the rule of law. The problems are (1) one cannot count on S Ct & (2) in a functioning system, Congress would not be absent when it comes to enforcing limits on executive power. But yes, D Ct judges have done their jobs
