Maybe their "both sides equally bad" approach is out of date? Micah L. Sifry Sep 18, 2025 Saturday, I got a pressing email from Heidi and Guy Burgess of the “Beyond Intractability” newsletter. Titled “URGENT ANNOUNCEMENT” it urged me to attend a “very important” online event happening Sunday late afternoon called “Dignity Over Violence.” As the Burgesses wrote, the call was launched as a response to the Charlie Kirk assassination, by Braver Angels, a national nonprofit focused on depolarization, and was “intended to help all of us in (or interested in) the civic-renewal, democracy, bridge-building, conflict resolution, and peacebuilding communities begin the work of alignment and collective action around this U.S. crisis.” Some 26 groups were cosponsors of the call, including Bridge USA, Civic Renaissance, Common Sense American, Civic Health Project, Disagree Better, Dignity Index, FAIR, New Pluralists, Listen First Coalition, Living Room Conversations, Mediators Foundation, Mormon Women for Ethical Government, National Civic League, National Institute for Civil Discourse, Numbers USA, One America

Thus stated, this theme dominated the comments that followed. Braver Angels national ambassador John Wood talked of his regret that he didn’t try to talk to Kirk the one time their paths crossed at a conference because “I let my agitation and disagreement get the better of me.” Jim Robb of NumbersUSA, which says it advocates for “lower immigration,” shared his belief that “in the last few years we’ve had too much self-regard and not enough love for our enemies.” Keith Allred of the National Institute for Civil Discourse said “we need more of everyday Americans raising their voices and engaging, less ceding of the stage to extremists.” Kristin Hansen of the Civic Health Project said, “Each of us has to decide in their own heart, I want to be a bridger, not a divider.” Citing again the artificial effects of social media, she urged the audience to “resist the temptation to succumb to the whirlwind forces, the algorithms, the provocateurs, who want to whip us into a frenzy, who benefit most when we’re divided from one another.” Heather Blakesee of Root Quarterly and FAIR said, “Sometimes I think that our political chasm isn't a parallel line. So we need to start where we are, in our communities, in our neighborhoods, and that's what will eventually bring us back.”

Just now, the officer called again.
Apologized for his earlier attitude.
Said my client will be released tonight.

And I didn’t even have to file the habeas.

This system is designed to detain — not to do justice.
But we fight anyway.

Congressman Suhas Subramanyam’s office stayed on ICE all day. Chief of staff @abbycarter.bsky.social was a force behind the scenes.

Why is this even happening?

Likely because of a Trump-era EOIR memo (PM 25-31) about “administrative transfers” — causing files to get split between locations.

ICE was looking at the wrong file. But I made clear: doesn’t matter.

He said, “OK, he’ll be out tomorrow.”

I texted right back:
“No. Not tomorrow. Tonight.”

When the officer finally called, he told me:
🗣️ “Well, we can’t just drop him off. He doesn’t have an ID. I need to see a bus ticket…”

I cut him off.

“I don’t care what you want to see. A judge dismissed the case. Let him go. Now. Or I’ll file a habeas and drag you into federal court.”

I send the signed judge’s order to ICE.
Their response?
🧊“The deportation officer will reach out.”

I said, “That’s not a legal answer. I emailed OPLA — I’m asking under what authority you’re holding him.”

Silence.

On Monday, ICE (in Virginia) does not oppose my motion.

The judge grants it, terminates the case. This should be over.

But by Wednesday…
🚨My client is STILL detained.🚨

By now my Spidey-sense is blaring.
I’m calling ICE duty attorneys in Pearsall, San Antonio, etc.

Crickets.

So I filed a motion to terminate proceedings — and guess what?

An ICE officer in Virginia called me and said:
🗣️ “Yeah, we looked into it. You’re right. USCIS messed up. We’ll release him tomorrow.”

Friday in South Texas:
ICE officer visits my client and says “We’re considering your release... just wait here.”
Then leaves. Never comes back.

Nope. ICE filed removal charges 3 days later, saying he overstayed — despite USCIS having REOPENED the case.

They didn’t even check before throwing him into detention and then into deportation court.

They sent him from Virginia to SOUTH TEXAS. Away from his wife and family.

Congressman @suhasforvirginia.bsky.social ’s office got involved (yes, the same Suhas I ran against in 2019 👀) — and USCIS admitted error on Sept 8.

They reopened the green card case and resumed processing. Victory?

My client’s green card application was denied by USCIS — wrongly. Prior counsel filed a motion to reconsider showing the error. Just another Tuesday.

Then, for NO REASON, ICE picked him up. No record. No arrest. Not even a parking ticket.

Let me show you how the ICE machine is designed to keep people detained — even when they have no business being there.

It shouldn't have taken this long, and it shouldn't have even happened...but finally, a little more justice in the world.

It just says so much, on so many levels. And none of them are good.

Even in virtual hearings, we (my clients and I) are required to have our cameras on and identify ourselves by full name. If we refused, it would be like not showing up. Yet somehow the government lawyers now don't have to identify themselves?

It's bad enough that ICE agents who are abducting people out from courthouses and schools and workplaces are invariably masked. Now the attorneys representing the *government of the United States* are trying to hide themselves?

ICE Lawyers Are Hiding Their Names in Immigration Court ICE attorneys fighting to deport immigrants are able to obscure their identities — no masks required.

ICE attorneys are refusing to be named in court and (some) judges are ok with this?

I have not personally seen this happen yet, but if I do, I would put the ICE attorney's name in the record myself.

State-sponsored terrorism. People need to wrap their heads around the fact that this is what ICE is, and we need to abolish this outlaw agency. It serves no moral or ethical purpose, and it's people should be on trial for crimes against humanity.
