Depends on the context. You seem to lack the nuance of an educator like me and only see life as it exists in your bubble. Framing each situation holistically you gain an understanding that one may or may not agree with but it adds a level of context to the debate.

Depends on the context but the first amendment has actually been used successfully in case law to defend someone from the consequences of what was perceived as hate speech

Yes. But I don’t think misgendering has gotten to this level in many parts of the country that would lead to school discipline. Even in California there isn’t a consensus amongst teachers even in the same school that misgendering would be considered a slur.

So basically a large portion of society would then disagree that it’s a slur of used outside a racial undertone. You and I might agree that’s a slur but their disagreement would probably be constitutionally protected which is the point I’m making.

I guess I’m more referring to a macro level context (society as a whole). I agree for some misgendering can be hurtful and at a micro level it’s a slur. I’m just not sure it’s at the powerful enough societal level where the law can come in and protect you.

At the time society as a whole did not considered it a slur. Society changed as did both popular demand and opinions of the ruling class and thus it became the slur (still used a lot but I notice mostly peer to peer without racial context)

True but in America I don’t think you can constitutionally determine what is or not a slur, as in the slur itself with no context. But I might be mistaken.
