The dead bicyclist's family brought a tort - wrongful death civil suit against the driver, but it was dismissed.

In March 2025, the driver pleaded guilty to EXCEEDING POSTED MAXIMUM SPEED LIMIT: 69 MPH IN A POSTED 60 MPH ZONE on the ICC/MD200 and received probation before judgment.

I am not under the influence of any alcohol or drugs. I have a back injury which I have acute chronic pain. I am on prescription medication. I am currently taking Oxycodone, not sure of the strength. I take one pill in the morning, one in the afternoon, and one in the evening (3 total/day). I also take Vicodin 4 times per day. I am taking them as prescribed. My doctor is [redacted by ACT]. I am giving this statement freely and voluntarily.

The posted speed limit was 35 mph. The police calculated, based on assumptions, that the driver "was traveling at most between 35 and 37, in a 35 MPH zone." The car stopped "approximately 82 feet from the area of impact."

The dead bicyclist was found at fault by the police for

▪️failing to ride to the right along a road he was crossing
▪️failing to have front/rear lighting for an impaired driver approaching from the side to see
▪️failing to wear a helmet the law did not require him to wear

Imagine if you could take a MARC Brunswick Line train to Harpers Ferry, from DC or MoCo, for a day trip or weekend getaway.

Police also concluded that the 47-year-old bicyclist was not wearing a helmet - citing a law (MD Transp § 21-1207.1(c)) that only applies to people under 16.

The impaired driver did not brake before impact. The bicyclist's body ended up "approximately 111 ft west of the defined area of impact."

It is not possible to ride all the way to the right along a road that you are riding across.

The police crash supplementary investigation said "The signal was operating properly at the time of the investigation" but that was wrong. The beg button on the east side worked. However, he was crossing from the west side, and the beg button on the west side was broken.

Zero patience this morning with accounts who oppose consequences for dangerous drivers because that doesn't fix the dangerous system.

The #TransitCat of the day (x 2) believes that buses should be on time.💜

#TrafficViolence involves three, interrelated factors:

1. Dangerous street/road design
2. Dangerous vehicles
3. Dangerous drivers

If you want safer streets, you have to think about all three factors.

Many drivers who hit & kill pedestrians had a previous history of dangerous driving (high speeds, DUI, red light running, etc).

The systemic change has to include: if you are a dangerous driver, you will no longer be allowed to drive.

8/20/24: the driver (24/M) of a 2021 Genesis G70, going ~100 mph, hit & killed a worker on a lawnmower crossing Great Seneca Hwy/119 at High Gables Dr.

6/17/25: he pled guilty to felony vehicular manslaughter (CR.2.209).

9/26/25: he was sentenced to 5 years in jail, all but 18 months suspended.
