Just to tie this in a tighter bow: Dudley and her ilk only vociferously defend cost-benefit analysis/OIRA when it "happens" to block regulations. They're not interested in better policy; they're interested in blocking regulations. And we should treat them as such.

Dudley has no authentic claim to being interested in promoting "good government" or "sound policymaking." To the extent she can muster any criticism at all it's that the Clark memo minimizes the role of OIRA -- as if the value of OIRA is self-evident.

This memo dumps on cost-benefit analysis and OIRA and other executive orders governing regulatory analysis. If a Biden OIRA administrator had written something like this, she would be apoplectic. But clearly she buys into the dual standard for regulation vs. deregulation that undergirds the memo.

it is actually kind of bananas how unitary executive theorists have taken a straightforward clause requiring the president to "faithfully execute the laws" and transformed it into a grant for the exercise of limitless unenumerated power.

(2) seems to be an even more dubious point than (1). first because agencies are shaped by congress as well as executive appointments, and second because the agency rule-making process is more transparent and democratic than top-down decrees from political appointees
