I'm Policy Director at @progressivereform.bsky.social where I specialize in federal regulatory policy. When not analyzing federal regulatory policy, I enjoy silent film, soccer, and running. "Oh! I'm sorry! This is abuse."

Can y'all just stop writing interesting stuff for like 2 or 3 months? I'm trying to catch up.

Just to tie this in a tighter bow: Dudley and her ilk only vociferously defend cost-benefit analysis/OIRA when it "happens" to block regulations. They're not interested in better policy; they're interested in blocking regulations. And we should treat them as such.
09.12.2025 16:46 β π 2 π 0 π¬ 0 π 0Dudley has no authentic claim to being interested in promoting "good government" or "sound policymaking." To the extent she can muster any criticism at all it's that the Clark memo minimizes the role of OIRA -- as if the value of OIRA is self-evident.
09.12.2025 16:28 β π 2 π 1 π¬ 1 π 0This memo dumps on cost-benefit analysis and OIRA and other executive orders governing regulatory analysis. If a Biden OIRA administrator had written something like this, she would be apoplectic. But clearly she buys into the dual standard for regulation vs. deregulation that undergirds the memo.
09.12.2025 16:28 β π 3 π 0 π¬ 1 π 0"In many ways, Clarkβs memo is well-crafted and well-reasoned...." My goodness, this is embarrassing from Dudley.
I've been eagerly waiting for her views on this memo. I was hoping for better, but her response is so disappointing.
"Every President since Ronald Reagan has relied on OIRA to improve regulatory quality."
What is the definition of "quality" here?

09.12.2025 15:42 β π 3 π 0 π¬ 0 π 0it is actually kind of bananas how unitary executive theorists have taken a straightforward clause requiring the president to "faithfully execute the laws" and transformed it into a grant for the exercise of limitless unenumerated power.
09.12.2025 14:20 β π 5418 π 1174 π¬ 109 π 44(2) seems to be an even more dubious point than (1). first because agencies are shaped by congress as well as executive appointments, and second because the agency rule-making process is more transparent and democratic than top-down decrees from political appointees
