This win of a ruling keeps Medicaid money flowing for now, but it's only put on a seven day hold to allow the Justice Department to seek relief from a higher court.

The Helms Amendment was passed in 1973 as part of the backlash to Roe. It prohibits the use of U.S. foreign assistance funds for abortion “as a method of family planning.”

If the court rules in Jessica Kalb’s favor, it could crack open Kentucky’s entire forced-birth framework and force the state to admit its ban is a constitutional disaster. If she loses, Kentucky locks in a precedent where embryos are afforded more legal clarity than the PEOPLE who create them.
