illegal entry and reentry are crimes, yes, but visa overstay is still not a crime under that act. it's a civil infraction and an important distinction when right-wing rhetoric insists that immigrants who have overstayed their visa are criminals-they are not.

that code covers improper entry into the country (i.e. sneaking across the border)...overstaying a visa is not entering improperly.

overstaying a visa (like the majority of undocumented immigrants have done) is actually not a crime. it's not in the criminal code. it's a civil violation, like a speeding ticket
