2. O voto do Min. Gilmar Mendes vai na linha de que só a finalidade válida de fiscalização tributária não é suficiente, sem um esquema procedimental que contenha salvaguardas concretas, além de se violar a reserva legal. O tal convênio que foi validado não contém balizas.

1. O julgamento foi apertado, 6x5. Venceu o voto da relatora min. Cármen Lúcia que, no mérito, entendeu não haver inconstitucionalidade porque se trata de uma "transferência de sigilo". 2024 e ainda estão decidindo casos com base na lógica de que 'se todo mundo mantiver segredo tudo bem'.

Hoje me deparei com essa notícia da @folha.com sobre o julgamento da ADI 7276 sobre dever de instituições financeiras entregarem dados a fiscos estaduais. O caso é emblemático de como chavões ultrapassados de sigilo de dados persistem.

Olha só, havia me escapado essa mudança de entendimento do Min. Dias Toffoli no ARE 1042075 - reconhecendo a necessidade de autorização judicial para acesso a dados em celular em geral, ao que parece, e abandonando aquela viagem que permitia acesso sem ordem judicial para certos tipos de dados.
