Another thing I want to share is that the Propublica analysis directly addressed your concerns about the maternal mortality rate during the pandemic. They note the bump caused by the pandemic, and then note that the national rate eventually declined while the Texas rate increased.

National won’t work here because the nation has a patchwork of laws and bans.

The principal of double effect is not part of American law or our biomedical ethics.

The problem I see is that the anti abortion movement considers things to be *not abortion* that the laws and doctors do consider to be abortion, particularly delivering before viability in the case of a threat to the mother's life.

The challenge here is that when I shared the data we do have you were not willing to accept it and suggested it was deliberately intended to mislead. What type of data about American state bans would you be willing to consider credible?

It would be entirely possible to write a law that bans elective abortion and gives ample grace to physicians who use reasonable judgement to intervene when a woman's life is threatened. I'm very confused why, instead of advocating for that, people keep attacking the doctors and defending the law.

26.02.2026 04:03 β€” πŸ‘ 1    πŸ” 0    πŸ’¬ 1    πŸ“Œ 0

Barnica's husband was told that they had to wait until there was no heartbeat, or it would be a crime. Yes, absolutely the hospital screwed up. They screwed up because the law is overly restrictive and doesn't protect the doctor or the mother well enough.

I think the issue here is that I'm specifically arguing that these *particular* laws are badly written and have endangered and killed women. I'm not speaking on Ireland, nationwide U.S. maternal stats or anything else.

And yes, red state healthcare sucks, but this made it worse.

26.02.2026 03:47 β€” πŸ‘ 3    πŸ” 0    πŸ’¬ 0    πŸ“Œ 0

All that was needed to save these women was a doctor willing to induce labor *before* the infection began. It doesn't require directly taking the child's life. Induction would be licit under Catholic teaching. But the ways the laws are written is too strict.

Elsewhere you mentioned Ireland. This is essentially the same scenario that was instrumental in overturning Ireland's abortion ban. A woman in preterm labor with a baby who is far too early to survive also dies because doctors won't intervene.

She died of sepsis from a uterine infection, and yes there were retained products of conception. Why did she develop sepsis? Because she was in labor for more than three days. Why was she left in labor that long? Because the doctor was trying not to break the law.

A Texas Woman Died After Waiting 40 Hours for Miscarriage Care Josseli Barnica is one of at least two pregnant Texas women who died after doctors delayed emergency care. She’d told her husband that the medical team said it couldn’t act until the fetal heartbeat s...

These laws have absolutely hurt women, like Josseli, who died of sepsis because her doctor was intimidated by the law and did not intervene in her inevitable miscarriage because of a fetal heartbeat.

Our law was written with NO life of the mother exception, only "affirmative defense" which means a doctor can be indicted and prosecuted and can use the necessity to save the mother's life as a defense in court, like a self defense law. Thankfully this was changed, but not before women were hurt.

Re: ectopics idk if there is a widespread belief that treatment is illegal. However, I live in an abortion ban state, Tennessee, and our abortion ban was so poorly written that a woman in my city had to wait 10 hours for treatment of an ectopic while hospital consulted with their lawyers.

I wasn't discussing the overall maternal mortality rate of the whole nation. In fact I wasn't discussing the rate at all but Propublica has done in depth analysis and found a large increase in maternal death in Texas after their ban.

When they've been told they will be prosecuted if the patient isn't at death's door, well, they wait til she is.

Who among us is willing to risk a felony and loss of our livelihood and career if we make the wrong call at work? But abortion ban proponents expect doctors to do exactly that in obstetric cases, and doctors usually choose to risk the patient instead.

25.02.2026 18:47 β€” πŸ‘ 4    πŸ” 0    πŸ’¬ 1    πŸ“Œ 0

I'm amazed at the cognitive dissonance. Abortion bans are designed specifically to intimidate doctors. Yet when they work as designed and intimidate doctors into delaying or denying care for miscarriages and ectopics, the doctors are blamed.

There is currently a bill here in Tennessee that would allow the *death penalty* for abortion; a long way from the "love them both" we used to hear about.

We are going to see escalated attempts to ban birth control and to punish women for abortion because the RW hasn’t got what they wanted when Roe was overturned.
