"This lawsuit is not about protecting trade secrets—it is about punishing a former employee for daring to leave," he said. He also says the enforcement of a noncompete will "effectively exile me from this profession."

He says he has begun working for Spire Motorsports and is not doing similar work to what he did for Joe Gibbs Racing, calling the suit a "public spectacle." He also emphasized he did not "transmit, distribute, or share JGR confidential information" and does not plan to.

Gabehart has filed a declaration in opposition to the requested TRO in the Joe Gibbs Racing case, claiming that the company breached the employment agreement by withholding his wages and that he doesn't believe the non-compete is enforceable. #nascar #nccourts

I note the date because this is incredibly fast for the courts. The majority of cases in federal court move much, much slower than this one and the prior NASCAR antitrust suit.
