Assemblymember Boerner has decided to hold AB 353, a bill that would have resulted in affordable internet plans for low-income Californians. The following is her statement on the decision:

βUnfortunately, due to President Trumpβs drastic new changes (https://www.ntia.gov/other-publication/2025/fact-sheet-ending-biden-s-broadband-burdens) to the Broadband, Equity, Access and Deployment (BEAD) program, I have made the difficult decision to shelve my legislation that requires internet service providers to provide affordable home broadband internet to low-income Californians. The new BEAD program regulations implemented by the Trumpβs loyalists at the NTIA push the bounds of federal jurisdiction over stateβs rights, as we have seen over and over with this dangerous Administration. Although I fundamentally disagree about the federal governmentβs authority to preempt Californiaβs rights in this space, the change has introduced too much legal uncertainty and put at risk $1.86 billion dollars in federal broadband infrastructure funding that I know the Trump administration would take joy in keeping from Californians. President Trumpβs new rules only serve to benefit corporate internet service providers taking public subsidies at the expense of low-income Americans.β

βAlthough I am pausing my bill for now, I am committed to working with my colleague Senator Durazo on her effort to expand the stateβs existing Lifeline telecommunications program to allow support for home internet access. I look forward to working my colleagues in the Assembly and the Senate to make sure no Californians are left without an essential service that impact their ability to participate in everyday life.β
