Mark was copied into correspondence from May onwards about this issue, so it is a very fair question to ask why this change was made at this point given the issues were self-evident 6 months ago.

The party has to hold lawful elections & Constitution Art. 2.7 which members voted to adopt, says that the EA holds sway. The quota in 2.5 was unlawful & has been corrected. But in trying to appease the aggrieved, they have over-provided for the groups covered by 2.6c & d; they’re still not happy.

That often happens at lower courts and then the Supreme Court has to look carefully at all the written briefs that come in. I was astonished that Stonewall did not submit an intervention, especially as individuals can’t submit personal testimony, just points of law.

Don't be silly - of course it doesn't 'rewrite' the law. It interprets EA2010 as it was intended. People were (deliberately or misguidedly) misinterpreting the law, but feminists have been saying for many years this was wrong

You can stand for transmen, whose rights (if pregnant) have been safeguarded by this judgment, & which Scottish Ministers would happily have abandoned. And the judgment is clear that the protected characteristics of transwomen & transmen remain exactly as written into the Equality Act; 1/2

Nobody is “interviewed by the Supreme Court;” the Court doesn’t hear individual experiences. Groups can submit files on points of law, which is what the lesbian groups did, in intervening to support For Women Scotland. Stonewall or Mermaids could have done so to support Scottish Ministers: but no.

It is not “transphobic” to expect your employer to respect & protect your right to appropriate single-sex facilities at work: Workplace (Health, Safety & Welfare) Regs. 1992, regs 23 & 24. Women have rights too!

The wrongdoing was on the part of Dr Upton & the HR of NHS Fife, who should have protected and respected the women’s spaces. Upton had spaces in the Doctors’ Mess to use.

Speaking the truth and fighting for women’s sex-based rights is not “bigotry.” Her protected beliefs have been judged “Worthy Of Respect In A Democratic Society.” Dr Upton’s actions, on the other hand, in breaching the women’s single-sex spaces, are unlawful & unlikely to be WORIADS!

Yes, we have seen from the testimony that Nurse Peggie, with 30 years’ unblemished service, didn’t want to be bullied by a petulant young Dr. who shd have used the changing room in the Doctors’ Mess. Upton had "previous difficulties" with another colleague & kept a log of “difficult interactions.”

She did not go into her changing room on the first two occasions when she found Dr Upton using it, so she did not have unfettered access to the cubicles. Why was DU there at all, when Doctors have their own space?
