There’s language on this in NYT v. Sullivan, too, I believe.

But what Bantam said is that 1A covers booksellers. It gets heightened scrutiny from simply commercial speech.
Neither BB or TT directly engages in the speech, but their actions get higher protection.

That’s closer to commercial speech, but Bantam Books would probably say that’s 1A protected.
Marketplace of ideas would exist and opportunity open new sources.

There are some restrictions such as in radio ownership, but that’s because radio waves are limited.

Otherwise, Schenck and Abrams would have gone the other way.
Basic 1A stuff.

This is a sly move by Wray.
This prevents Kash Patel from being the Acting FBI Director for at least a year.
Patel would have to have been at the FBI for 90 days in the year preceding Wray leaving to be eligible for Acting FBI Director.

I thought that’s what the first decision would be, too.
It’s still early for decisions by recent SCOTUS standards.

The Supreme Court’s website now lists next Tuesday, December 10, as a day on which “the Court may announce opinions.”
In other words, looks like we’re getting the first full ruling(s) of the term on Tuesday (the only one thus far was a dismissal after argument).

I think the Supreme Court probably upholds the Tennessee law in Skrmetti.
It’s either 5-4/6-3 that the law is okay depending on Gorsuch.
There’s a less than 25% possibility it’s remanded to TN for fact finding with intermediate or rational basis test.

The Supreme Court is releasing their first opinion of the term, today.
Prediction: They dismiss as improperly granted (or DIG) NVIDIA v. Ohman.

There was a potential 3A case with secret service over the summer.
Don’t think it would qualify, but funny people even discussed it.
