If they're lying and don't have the gem : Yes
If they're telling the truth and have the gem : No
If they're telling the truth and don't have the gem : Yes

So if the answer is "no" they have the gem.

Imo this is usually explained by a mistake / not paying enough attention. That said, I'd love to see all the images generation AIs be shut down. They're trained on stolen art. I'd also love to see them get sued into oblivion for that...
