I bet this is not the C&O Canal but the (long since filled in) Alexandria Canal on the other side of the river. It doesn't look like any spot on the C&O I can imagine. If it is then fill has radically changed the area now.

The part I don't like is the elision from "no court will enforce this law" (correct) to "law is irrelevant" (incorrect). If 51 senators or 51 million people think presidents shouldn't have the power to make war, it is not illegitimate (much less irrelevant) to frame that argument in legal terms.
