NEW: Pete Hegseth said he'd appeal a ruling blocking him from demoting Democratic Sen. Mark Kelly for reminding troops in a video that they’re obligated to refuse unlawful orders.

The development will move Kelly’s countersuit against the defense secretary to the D.C. Circuit Court of Appeals.
