It occurs to me that Trump is attending the Super Bowl and Kendrick Lamar, likely the greatest diss track artist in history at the peak of his powers, is performing at halftime… and does Trump really want to expose himself to that risk?

It also applies to the same sort of article submitted by a professor, when 2L editors aren’t sophisticated enough to know they’re poorly reasoned. And those articles then become some of the strongest persuasive authority out there.

I’m grateful he caught thatβ€”the 2Ls cite checking the piece and the 3Ls doing final edits (of course!) did not have sufficient tax expertise to be able to correct that error. Nor did they have sufficient time to run the math on it and cross check it against relevant statutory authority and caselaw.

A relevant anecdote 🧡: in an early draft of my Note published in the Georgia Law Review last year, I had asserted that a hypothetical transaction was subject to income tax at a top 37% rate. My Note advisor pointed out that the transaction should properly be subject to the gift tax at a 40% rate.
