Heritage also understood that time-pressed reporters were already adopting the horrid he-said/she-said style that plagues journalism today. If we got wind that some world-class Brookings scholar was due to release a book on, say, national health insurance that made an original contribution to knowledge in the field, someone at Heritage would quickly draft a short paper rehashing the same old talking points attacking national health insurance that had been around forever and release it the same day as the Brookings study. More often than not, we would get a story in the Washington Post the next day saying little more than this: โToday the Brookings Institution published a book, 3 tears in the making, advocating national health insurance, and the Heritage Foundation released a report on the same subject saying it would bankrupt the nation and lead to a deterioration in health quality.โ Reporters never distinguished between the quality of one study and the shallowness of the other; they both got conflated and prevented the other side from getting traction on an issue.[vi] This method still works today.

As for the evidence Defendants marshalled through Parra with respect to CBPโs actions, Parra testified in his deposition that he had only been in the field with CBP a โhandful of times, four to five,โ during Operation Midway Blitz. Doc. 191-9 at 30:7โ10. And he made clear that he based much of his declaration on information he gleaned from use of force reports, with maybe some (unidentified) review of video footage. See, e.g., id. at 81:17โ82:16, 85:17โ23, 86:15โ91:1 (describing that Parra viewed some video footage, but that he could not recall how much or of what events). Given the inconsistencies between the BWC footage and the use of force reports, with the BWC footage undermining what agents put in their reports, the Court cannot rely on Parraโs broad generalizations of protestersโ actions or Defendantsโ responses to those actions. [FN 9] [FN 9] 9 The Court also notes that, in at least one instance, an agent asked ChatGPT to compile a narrative for a report based off of a brief sentence about an encounter and several images. To the extent that agents use ChatGPT to create their use of force reports, this further undermines their credibility and may explain the inaccuracy of these reports when viewed in light of the BWC footage.
Judge Ellis also found that a top CBP leader's testimony was not credible, in part because he admitted that was relying on unreliable "use of force" reports generated by DHS officers โ and in a footnote, says video showed an officer asking ChatGPT to help him fill out a use of force report!
