French lawmakers on 28 January passed an amendment to an anti-drug trafficking bill before the French Senate requiring encrypted messaging services (WhatsApp, Signal, Telegram) to allow intelligence services to access the "intelligible content" of the messages being transmitted. While some senators opposed the amendment tabled by Senator Cédric Perrin, citing privacy risks and potential breaches of European law, Interior Minister Bruno Retailleau and Justice Minister Gérald Darmanin fully supported it. The amendment emerged from hearings of the Parliamentary Intelligence Delegation (DPR), whose membership includes Perrin. The DPR consists of four MPs and four senators and is tasked with monitoring government policy on intelligence matters.

No Pegasus Darmanin pointed out that what he called "private companies" have products to access communications passing through such messaging apps, alluding to Israeli firm NSO Group's Pegasus spyware - and apparently showing some confusion over the difference between offensive technical solutions and legal backdoor access. "A few years ago, the President [Emmanuel Macron] decided within the defence cabinet to reject foreign solutions, in particular Israeli ones, and to develop French State solutions internally. We do not subcontract such administrative or judicial spying, as many countries do," said Darmanin (IO, 19/06/24). The Technical and Innovation Directorate (DTI), attached to the foreign intelligence DGSE, is working on the issue (IO, 09/01/25), as are its domestic intelligence cousins at the DGSI. The amendment is also inspired by a precedent in the United Kingdom, where Perrin said that backdoors have already been imposed on encrypted messaging providers. Perrin, from the conservative Les Républicains party, also presides the Senate's Committee on Foreign Affairs, Defence and the Armed Forces.
